Our client, a 68 year old woman, was driving in Bella Vista, Arkansas when she collided with another car which had to swerve to miss a third vehicle who had made an illegal turn.  As a result of the wreck, our client spent six weeks in a rehab hospital recovering from her injuries and incurring more than $75,000.00 in medical bills.  Unbelievably, both of the other drivers were driving without insurance.  Our client carried $50,000.00 in uninsured coverage.

The difficulty in this case was not obtaining the $50,000.00 in underinsurance.  The difficulty was working with Medicare that paid for our clients medical bills.  The challenge was to work with the medical providers to ensure that they submitted the bills to the health insurance companies and negotiate with the health insurance companies to ensure that they did not take all of the money from our client that she was due under her uninsured coverage.  Through a long process, we were ultimately succesful in getting all of the bills paid and entering into an agreement with Medicare to accept an amount which would still allow our client to be reimbursed for her pain and suffering.

This case is an example of where an experienced attorney can make the difference on a case.  If an attorney that did not have the experience would have settled this case immediatly all of the money would have gone to the medical providers and the lawyer leaving nothing for the client.  Knowing how to deal with the medical providers and other insurance carriers is much more important and much harder than simply proving that the client is entitled to the money.
